1. Acceptance of Terms

By accessing the website, creating an account, using the Platform, uploading a resume, applying for a job, posting a job, searching candidates, using AI services, purchasing a paid service, or otherwise using PharmaStaffX, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform.

2. Eligibility

To use the Platform, you must provide accurate information, have the legal capacity to enter into applicable agreements, and comply with applicable law and these Terms. By using the Platform, you represent that you meet these eligibility requirements.

3. PharmaStaffX Platform Description

PharmaStaffX is a technology platform that provides recruitment and career services. Functionality may include:

• Candidate services: Job discovery, search, and applications; profile management; resume uploading; AI Resume Analyzer; career recommendations; and AI job matching.
• Employer services: Employer registration, company profiles, job posting, candidate search, AI-assisted candidate matching, applicant management, and recruitment communication.

We may modify, suspend, update, restrict, or discontinue portions of the Platform where reasonably necessary for maintenance, development, legal compliance, or other business purposes.

4. Platform is a Technology Service

PharmaStaffX provides technology and recruitment-support functionality. We do not automatically become the employer of a candidate, the employee of an employer, the recruitment agency of every employer, a party to every employment relationship, a guarantor of every job listing, a guarantor of candidate qualifications, or a guarantor of employer conduct.

5. Candidate Terms

Candidates are responsible for providing accurate resumes, professional qualifications, employment history, educational information, contact information, authentic certificates/documents, and application information. You must update your profile information and protect your account credentials. You are responsible for reviewing job descriptions and conducting reasonable due diligence before accepting employment.

Candidates must not create fake identities, upload fake resumes, misrepresent qualifications, submit fraudulent documents, impersonate another person, apply using another person's identity, manipulate AI results, or misuse employer information.

6. Employer Terms

Employers and recruiters must provide accurate company information, job descriptions, legitimate job opportunities, and qualification requirements. You must use candidate data only for legitimate recruitment purposes, protect candidate information, and comply with all applicable employment, anti-discrimination, and privacy laws.

Employers must not post fraudulent jobs, collect unnecessary sensitive information, misrepresent salary or job locations, harass candidates, discriminate unlawfully, spam candidates, sell candidate information, scrape candidate information, or use candidate data for unrelated purposes.

7. Job Listing Disclaimer & No Guarantee of Employment

Job listings may be submitted by employers, recruiters, recruitment agencies, or organizations. While PharmaStaffX may provide tools to improve Platform integrity, we do not guarantee that every listing is accurate, complete, current, available, legitimate, or suitable.

PharmaStaffX does not guarantee employment, interviews, job offers, candidate selection, employer response, salary, promotion, career advancement, hiring timelines, candidate availability, job availability, or recruitment completion. The Platform facilitates technology-enabled connections but does not guarantee outcomes.

9. User Content & Representations

Users retain applicable rights in their User Content (resumes, profiles, job descriptions, applications). You grant PharmaStaffX the limited rights necessary to host, store, process, display, transmit, analyze, format, deliver, and provide requested Platform functionality.

You represent that your information is accurate, you have the authority to submit it, your content does not unlawfully infringe third-party rights, your use complies with applicable law, and your content does not knowingly contain malicious code.

10. Prohibited Activities

Users must not:

• Hack the Platform, attempt unauthorized access, or circumvent security.
• Reverse engineer except where legally permitted.
• Scrape data without authorization or harvest candidate/employer information.
• Upload malware, ransomware, or unlawful content.
• Phish, spam, or harass users.
• Impersonate individuals or create fraudulent accounts, jobs, or profiles.
• Misrepresent qualifications or manipulate Platform ranking/AI functionality.
• Attempt prompt injection against Platform systems or extract confidential prompts.
• Attack APIs, abuse rate limits, or interfere with Platform availability.
• Use Platform data to build unauthorized competing databases.
• Use Platform information for unlawful discrimination or violate applicable laws.

11. Account Security & Termination

You are responsible for your password security, authentication credentials, and device security. You must immediately notify PharmaStaffX of suspected unauthorized access.

PharmaStaffX may suspend, restrict, or terminate accounts where reasonably necessary due to Terms violations, fraud, abuse, security threats, illegal activity, misrepresentation, unauthorized access, or risk to Platform integrity. Where appropriate and legally required, we will provide notice or an opportunity to resolve the issue.

12. Platform Availability & Third-Party Services

PharmaStaffX does not guarantee continuous availability, error-free operation, uninterrupted access, permanent availability of any feature, compatibility with every device, or availability of third-party services. The Platform may experience maintenance, updates, downtime, security incidents, or infrastructure failures.

The Platform depends on third-party services (hosting, authentication, AI infrastructure, databases, etc.) which may have independent terms and privacy policies. PharmaStaffX is not responsible for third-party content, privacy practices, or availability on external links.

13. Intellectual Property

Subject to applicable law, PharmaStaffX owns or licenses the Platform's software, source code, UI/UX, graphics, design, database structure, architecture, proprietary algorithms, AI workflows, documentation, and original content. Users may not copy, reproduce, distribute, modify, sell, reverse engineer, or commercially exploit these materials except as permitted by law or written authorization.

14. Privacy & Data Protection

Your use of the Platform is governed by our Privacy Policy. Personal data is handled according to the Privacy Policy.

Users must comply with applicable data-protection obligations when receiving or processing personal information through the Platform. Employers must not export candidate data unlawfully, sell candidate data, or use it for unrelated purposes.

15. Limitation of Liability

To the maximum extent permitted by applicable law, the Platform and services are provided without warranties that cannot legally be excluded. PharmaStaffX does not guarantee that AI analysis is always accurate or that job recommendations are suitable.

To the maximum extent permitted by applicable law, PharmaStaffX shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of your use of the Platform. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

16. Indemnification

Subject to applicable law, you agree to indemnify and hold harmless PharmaStaffX from claims, losses, liabilities, damages, costs, or expenses arising from your breach of these Terms, unlawful use of the Platform, User Content, violation of third-party rights, violation of applicable law, or fraudulent conduct.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without prejudice to mandatory rights that may apply to users under applicable law.

In the event of a dispute, parties agree to seek resolution through good-faith negotiation, followed by a written complaint and internal grievance review, before pursuing mediation, arbitration, or competent courts where legally appropriate.

18. General Provisions

• Force Majeure: PharmaStaffX is not liable for failure to perform due to events beyond reasonable control (natural disasters, internet failures, cyber incidents, etc.), subject to applicable law.
• Severability: If any provision is held invalid, the remaining provisions continue to operate to the extent permitted by law.
• Waiver: Failure to enforce a provision does not constitute a permanent waiver.
• Changes to Terms: PharmaStaffX may update these Terms. Material changes will be communicated via the Platform or email.
• No Waiver of Statutory Rights: Nothing in these Terms is intended to exclude, restrict, or waive any right, remedy, protection, or liability that cannot legally be excluded, restricted, or waived under applicable law.
